1. Introduction

Welcome to TouristRank, operated by TouristRank SRL, a company incorporated and registered in Romania (Registered Office: Bucharest, Romania, Registration No: [Insert], VAT No: [Insert], Email: adrian.urdar@gmail.com).

This Terms and Conditions document (“Terms”) forms part of the contract between you and TouristRank SRL. By creating an account, subscribing, or otherwise using the Platform, you (“User”, “Hotel”, “You”) agree to be bound by these Terms. If you do not agree, please do not use the Platform.

TouristRank is a business-to-business platform, available only to legally registered accommodation providers, designed to facilitate the responsible exchange of information about tourist behaviour and reliability, under lawful and privacy-compliant conditions.

2. Definitions

To make these Terms clearer, here are some important definitions:

• “Platform” – the TouristRank web application and website (www.touristrank.com).

• “User” or “Hotel” – a verified business entity operating in the tourism industry (e.g., hotel, pension, B&B).

• “Tourist” – an individual whose personal data or behaviour has been recorded on the Platform by a User.

• “User-Generated Data” – any data, review, or information input by a User into the Platform.

• “Subscription” – the chosen paid or free plan (Freemium, Monthly, Quarterly) under which the Platform is used.

• “Controller” and “Processor” – have the meanings given in the General Data Protection Regulation (GDPR).

3. If Part of These Terms Is Unlawful

If any authority decides that one or more clauses in these Terms are unlawful or unenforceable, the rest will remain valid and continue to apply.

4. Our Platform

1. TouristRank’s Role
   TouristRank provides and is responsible for the Platform itself, not for the accuracy of reviews or data submitted by Users.
   We facilitate the exchange of information, but we do not endorse or verify individual entries or their truthfulness.

2. Accuracy and Professional Diligence
   We take reasonable care and act with professional diligence to maintain the Platform and safeguard your data.
   Although we implement checks to identify inconsistencies or errors, we cannot guarantee that all User-generated information is complete or accurate.
   If errors occur, we’ll do our best to correct them promptly once we become aware.

3. No Recommendation or Endorsement
   TouristRank is not a recommendation or endorsement of any hotel, tourist, or review. It is a professional network tool designed for responsible use by verified businesses.
   
   

5. Our Values

By using TouristRank, you agree to:

• Operate ethically and in accordance with local and EU laws;

• Cooperate with any lawful anti-fraud or data-verification checks;

• Avoid entering false, defamatory, or misleading data;

• Use the Platform solely for its intended business purpose.

We reserve the right to suspend or terminate access if these principles are breached.

6. Subscription and Pricing

Current plans and pricing are available at: https://www.touristrank.com/pricing (the “Pricing Page”).

The Pricing Page forms part of these Terms and may be updated from time to time.

6.1 Renewals and Payments

• Subscriptions renew automatically unless cancelled through your dashboard before renewal.

• Payments are processed via Stripe, subject to Stripe’s Terms of Service.

• Fees exclude VAT or local taxes.

6.2 Pricing Updates

TouristRank may modify prices, billing cycles, or features at any time.

Only active paying subscribers will be notified of such changes.

Freemium users will not receive notices.

The latest prices shown on the Pricing Page always apply.

6.3 Refunds

No refunds are provided for partial periods or unused time.

6.4 Cancellations

You can cancel your subscription anytime. The next billing cycle will not occur, and you’ll retain access until your current paid period ends. 

7. User-Generated Data

7.1 Responsibility for Data

All User-Generated Data is the sole responsibility of the User who enters it.

TouristRank.com takes reasonable, industry-standard measures to detect inconsistencies, but it’s virtually impossible to validate every record.

Therefore, you are fully responsible for the accuracy and lawfulness of all data you input.

Providing false information can expose you to civil or criminal liability, including potential legal action from affected tourists.

7.2 Accuracy and Corrections

You must ensure that all data is factual, accurate, and promptly corrected when necessary.

TouristRank cannot be held liable for harm resulting from inaccurate or outdated information.

7.3 Consent Collection

Before entering a tourist’s personal data, you must obtain valid consent or rely on another lawful basis consistent with GDPR or equivalent laws in your country.

You must inform the tourist that their information may be shared with other verified accommodation providers through TouristRank.

7.4 Consent Form Templates

TouristRank may provide sample consent forms to assist you, but these are informational only and not legal advice.

You are responsible for ensuring your consent process complies with applicable data-protection laws.

7.5 Controller and Processor Roles

• Each hotel or business acts as a Data Controller for the data it uploads.

• TouristRank acts as a Data Processor, hosting and processing data on your behalf (see Section 14 – Data Processing Agreement).

8. Use of the Platform

You agree not to: 

• Use TouristRank for non-tourism or unlawful purposes;

• Enter false, discriminatory, or offensive content;

• Copy, scrape, or resell any part of the Platform;

• Attempt to bypass verification or technical limits.

Violation may lead to suspension or permanent termination without refund. 

9. Intellectual Property Rights

Unless stated otherwise, all intellectual property rights in the Platform — including its design, code, databases, text, trademarks, and visuals — belong to TouristRank SRL or its licensors.

By using the Platform, you agree to use it only for its intended purpose and in accordance with these Terms.

You may not, without written consent:

• Copy, monitor, scrape, or reproduce any part of the Platform;

• Use automated tools (bots, spiders, AI-powered assistants, etc.) to access or extract data;

• Perform actions that cause undue stress on our systems. 

We may block or suspend access to any account or automated system suspected of such activity.

10. Ownership of Data

• All tourist data entered remains the property of the User who provided it.

• TouristRank is licensed to store, process, and transmit that data solely for operating the Platform.

• The User is the sole legal custodian of the data and bears full responsibility for its lawful use.

11. Privacy and Data Protection

TouristRank processes limited personal data to operate its services.

For details about data collection, cookies, communication, and rights, please refer to our Privacy Notice. 

12. Service Availability

We aim to maintain continuous service but cannot guarantee uninterrupted operation.

Maintenance or updates may temporarily affect access.

We will take reasonable steps to minimize disruption.

13. Limitation of Liability 

TouristRank provides its Platform “as is.”

We are not liable for: 

• The content or accuracy of user-entered data;

• Losses or damages not reasonably foreseeable when you accepted these Terms;

• Any event beyond our reasonable control (e.g., outages, third-party failures);

• Mistakes in user-entered data (email, billing, etc.), unless caused by us.

Total liability for any claim is limited to the subscription fees you paid in the preceding 12 months.

14. Data Processing Agreement (DPA)

14.1 Scope

This DPA governs TouristRank’s processing of personal data on behalf of Users (Controllers).

14.2 Processor Obligations

TouristRank SRL will:

1. Process data only on your documented instructions;

2. Apply strong security and confidentiality measures;

3. Ensure authorised staff are bound by confidentiality;

4. Assist you in fulfilling GDPR obligations and data-subject requests;

5. Delete or return data after account termination unless legal retention applies;

6. Notify you of any personal-data breach within 72 hours.

14.3 Security

TouristRank employs:

• HTTPS/TLS encryption in transit;

• AES-256 encryption at rest;

• Secure password hashing;

• Access control and logging;

• Regular vulnerability testing.

14.4 Sub-Processors

TouristRank uses:

• Stripe Inc. – payments (USA & EU)

• DigitalOcean LLC – hosting (EU)

• Mailgun Technologies Inc. – transactional email (EU)

Each ensures GDPR-equivalent protection.

14.5 Retention

TouristRank retains all data as long as the User’s account remains active, even if unused.

If you terminate your account, we will delete or anonymize your data within 90 days unless required by law to retain it (e.g., for financial or legal reasons).

TouristRank does not delete data merely because an account is inactive.

15. Governing Law and Jurisdiction

These Terms are governed by Romanian law and applicable EU regulations, including the General Data Protection Regulation (GDPR).

Disputes shall be resolved exclusively by the courts of Bucharest, Romania.
